The Week reports that in Massachusetts, it is a felony punishable by up to 3 years in prison if you're convicted. Several other states, including Idaho, Michigan, Oklahoma, and Wisconsin, also classify it as a felony. Although it might be a misdemeanor in other places, penalties can still include up to 3 months in jail and a fine.
States like New York are trying to decriminalize cheating on a spouse by removing the relevant laws. This means that residents of New York could legally have extramarital affairs within the city that never sleeps.
